Agricultural Supply

Since our founding in 2000 we have been the continuous partner of agricultural supply companies of varying sizes and assist in both the continuing running of businesses as well as strategic business planning.

Our “day-to-day business” encompasses issues related to traditional trading operations, such as agricultural trading, machinery and spare parts trading, fuel trading, and similar activities, as well as matters concerning commodities, grain and goods exchanges and brokerage law. We must also mention experience in what is known as “second stage processing”, that is, facilities involved in food and/or feed production (such as mills, malt houses and breweries). Our consulting and representation include classical civil law topics, i.e. contract law, standard terms including known specialist material (e.g. standard terms and conditions in the German grain trade, Hamburg feed sales contracts, AVLB seed terms, Berlin Agreement) quantity determination, transportation and means of transportation, and other relevant special provisions (e.g. lien on crops under the Law on Securing the Supply of Fertilizers and Seeds of January 19, 1949)

Similarly, we address the continuously evolving framework governing public law. On the one hand this includes areas such as food safety (specifically the Food and Feed Code (LFGB)), the production of and/or trade in animal feed (FuttermittelV0), and the prevention and control of animal diseases in agriculture production (formerly the Animal Diseases Act (TierSG), now the Animal Health Act (TierGesG)). On the other hand, this includes the ever-larger body of directly applicable European law (exemplified by European agri-environmental law (so called “cross-compliance”)) as well as the growing body od safety law (occupational safety, including, for example, working from home, and, most recently in the fertilizer sector, Regulation (EU) 2019/1148 on the marketing use of explosive precursors.

Alongside this we also deal with corporate and business law matters, ranging from the required disclosures in business correspondence to corporate transactions and succession planning.
